1.            I, Thomas John against whom the said FIR has been lodged is the biological and only father of my two minor children Mercy Thomas (10 years) and Noel Thomas (7.5 years).  I also declare that I am ready to accept Veena Thomas without any pre-conditions if she is ready to withdrew all the cases filed by her at the behest of her 68 year old mother and alcoholic brother.

2.            The FIR and the criminal allegations which was filed by Veena Thomas has been filed at the behest of her mother and younger brother (Threasiamma Thomas and Akash Thomas).  Her father (John Thomas) is against this criminal case as well as the separation but is helpless before her mother and brother and it is feared that her younger brother also indulges in violence with his father.   Even now, Veena Thomas has filed this case and DV case in Womens court Patiala house court at the insistence of her mother, who in her old age wants to keep her daughter with her.  Her brother after marriage is settled in Mumbai and is directly responsible for making Veena Thomas a smoker and a drinker and for alienating me against my two minor children for which I will be invoking POCOSO Act separately against Akash Thomas in the appropriate forum.

                It is also an admitted fact that the younger brother of Veena Thomas (Akash Thomas who is a habitual drinker and suffers from high BP since childhood) used to come to our house once in four-five weeks since he worked in Wipro Okhla which is hardly 2 km from our residence.  My children also used to be very happy seeing their manu mama.

3.            I came to know about the FIR only in June, 2014 through RTI.  

4.            The complainant and I got married on 19.1.2004 as an arranged marriage in a catholic church in Pala, Kottayam, Kerala as per Christian marriage rites.  Her mother was not very much in favour of the marriage since she wanted to keep her daughter with her for her old age.  Veena Thomas’s brother is a vagabond who is a chain smoker and drinker and also suffers from high blood pressure since his childhood.

5.            The complainant and I were happily married for nearly 7 years and had a good time in our vacations in Kerala, Goa etc.in this regard, in June, 2010 we had gone to Kerala in summer vacations where we had stayed overnight with three relatives  mama, mausi and bua of Veena and Veena also expressed wish to again go to Kerala to climb a mountain after 2-3 years when the children are a bit older. 

6.            In fact the father and mama-mami and mausa-mausi of Veena Thomas still want the marriage to continue but are not in a position to intervene due to the adamant and criminal bent of mind of Veena’s mother.

7.            At the time of marriage, marriage was in Kerala for which it was agreed that engagement and marriage expenses will be shared jointly.  However, later on, Veena’s mother gave excuse that while coming for marriage by Train, she lost some money which she has tied up in her petticoat.  As a result for the engagement and marriage all the expenses were incurred by my parents and there was some bitterness of her mother during the marriage ceremony.

8.            There was no exchange of gifts during the marriage.  My elder sister who is settled in USA gave some gold items to Veena Thomas during the marriage.  After marriage also, it was seen that Veena did not have proper dresses so my mother gave 2-3 old suits of my sister to Veena for wearing.  For her MBA studies my parents have once given Rs. 20,000 to Veena.

9.            Veena Thomas’s mother retired in January, 2007.  At the time of retirement I had helped with their house shifting from IIT Campus to Neethi apartment, Patparganj.

10.          Veena’s father who is kept virtually as a prisoner in their house has purchased a house in Ayanagar Phase II which he wanted to gift to her daughter which was opposed by her mother.  However, he had made a will of his own account naming Veena and her husband and their children to be co-inheritors of the property which was not liked by Veena mother.  In December, 2010 on the pretext of taking Noel’s birth certificate for his nursery school admission, she had broken the lock of our house at B-191, DDA Kalkajijanta flats when no one was there and took those papers along with some cash and jewellery kept in the house.  However, Veena’s mother at that time had pleaded that you are my son and so I had forgiven them considering her as mother mary looking at her age, medical conditions and keeping the best interest of my two children in mind.

11.          It is also reiterated that Veena obtained signature of me on stamp paper and I also signed on it without verifying since her mother who is having bi-polar behaviour problems had suffered brain haemorage and after recovery had once told from Divine Retreat ashram of our church in Faridabad that god saved her from certain death.  It is also reiterated that after I read the agreement papers I was shocked and when I confronted Veena she told me that what I have written I am not going to change and that I am not going to give it to anyone and you need not worry on that count.   It is also reiterated that Veena Thomas’s mother is in the habit of taking sleeping pills for the past 10-15 years and lives a duplicate life without regard for the Court orders nor the emotional and physical safety of the two minor children.

When the complainant Veena’s mother suffered brain haemorage, my parents had gone to Vimhans hospital to see her and at that time Veena mother had held my mother’s hands and requested to pray for her. 

It is also reiterated that what ever I have done is for the protection and safety of my children for which I will take recourse to all possible legal steps.

12.          It is also reiterated that my parents regard Veena as their own daughter and even when we had gone to Kerala in summer of 2010, my parents had stayed behind in Kerala so that we are not inconvenienced.  In fact in September, 2010, Veena mother had suffered brain haemorage and at that time also my parents had prayed for her speedy recovery.

13.          I had given my email password of my email to Veena Thomas from which she used to chat with my sister also frequently from our home computer.  Similarly I had made my Syndicate Bank HauzKhas Saving account joint with Veena Thomas which shows the trust that I had for her and the trust which she enjoyed.

14.          It is also stated that Veena Thomas has filed DV case No. 11/41/2017 against me in the Womens Court, Patiala House Court in December, 2011 where also, because of the criminal mind of her mother, I am not able to see my two minor children for the past nearly 14 months.  The next hearing on the same is on 1st December, 2014.

15.          Since I was not agreeing to Veena Thomas’s mother’s threats of no-blame divorce etc, as  a pressure tactic they have filed a criminal case against me which also is in contempt of the undertaking given by me during the hearing in the Womens Court of Patiala House in case no. 52/2011. 

16.          I also request the respected IO to strictly take the statement and contradictions of Veena’s mother and younger brother (who was acting as the Father of my then four year old Son Noel Thomas during his birthday on 27.7.2011 in Neethi Apartment), and also her bed ridden helpless father John Thomas if the truth and justice has to prevail. 

                I also assured the IO that whatever price I have to pay, I will not seek out of court settlement and will fight till justice and fundamental rights are restored to me, my two minor children and also my aged parents (who were praying for Thressiama Thomas when she was about to die of brain haemorage for which they are not able to see their grandchildren for the past 3 years).

I, Thomas John is working as Private Secretary in the Department of Personnel and Training working in Staff Selection Commission, Block 12, CGO Complex, Lodi Road, New Delhi – 110003.  I assure the IO that I will leave no stone unturned to ensure that investigations are done in a proper and just way without compromising the fundamental rights of me, my parents and also my two minor children.
